AGREEMENT TO TERMS


These Terms of Service ("Terms") constitute a legal agreement between you, whether as an individual or on behalf of an entity ("you"), and Haute Academy, Inc. doing business as PastryClass ("PastryClass," "we," "us," "our," and collectively, the "Parties," or individually, a "Party"), pertaining to your access and use of the website located at the address pastryclass.com, along with any other media forms, channels, mobile websites, or mobile applications related to or connected with it (collectively, the "Website").

Please read these Terms carefully before using this Website. Your use of this Website indicates that you have read and accepted these Terms. If you disagree with any of these Terms of Use, please discontinue using this Website immediately.

We reserve the right, at our sole discretion, to modify these Terms at any time and for any reason. If changes to our Terms impact how we use your provided data, we will notify you of these changes.

All time references for classes and enrollments are based on the Greenwich Mean Time (GMT) zone.


INTELLECTUAL PROPERTY RIGHTS


Unless explicitly stated otherwise, all intellectual property on the Website is owned by us. This includes materials protected by copyright, trademark, or patent laws (the "Marks"). The Content on the Website, including but not limited to text, design graphics, software code, photos, videos, music, applications, interactive features (collectively, the "Content"), is a collective work under Canadian and other copyright laws and is the intellectual property of PastryClass.

Provided that you are eligible to use the Website, you are granted a limited license to access and use the Website and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Website, the Content and the Marks.


USING THIS WEBSITE AND THE WEBSITE’S SERVICES


USER REGISTRATION

You may need to register with the Website to access and utilize certain Service features. By registering for the Service, you agree to provide accurate, current, and complete information about yourself as prompted by the Service’s registration form. You are responsible for maintaining the accuracy of this information and updating it as necessary. Registration data and certain other information about you are subject to our Privacy Policy. If you are under thirteen (13) years of age, you are not authorized to use the Service, with or without registering. Additionally, if you are under eighteen (18) years old, you can use the Service only with the approval of your parent or guardian.

USER ACCOUNT, PASSWORD AND SECURITY

Your access to this Website must comply with these Terms. You agree to keep your password confidential and bear responsibility for all activities associated with your account and password. This includes passwords for third-party sites if we permit their use to access this Website. Notify us immediately of any unauthorized account use or security breach, and log out of your account at the end of each session when accessing the Service.

MODIFICATIONS TO SERVICE

PastryClass reserves the right to modify or discontinue, temporarily or permanently, the contents, formats or functionality of the Website at any time or for any or no reason at our sole discretion with or without notice. We will not be liable to you or to any third party for any modification, suspension, price change or discontinuance of the Website.

PAYMENTS

You will be required to select a payment plan and provide PastryClass information regarding your credit card or other payment instruments. We may suspend or terminate your account and/or access to our Services and this Website if your payment is late and/or your offered payment method (e.g., credit card or PayPal account) cannot be processed or is declined or revoked. By providing a payment method, you expressly authorize us to charge the applicable fees on said payment method as well as taxes and other charges incurred thereto. Fees for classes are collected by PastryClass from students via Stripe and PayPal services.

We reserve the right to change PastryClass’ payment plans at any time. If applicable, we may give you advance notice of the fee changes. If you don’t agree with the fee changes, you can cancel your account and stop using the Services.

5-STAR FULL REFUND POLICY

We offer a full refund if you decide to cancel your paid enrollment for a class within the first five days following your purchase. Upon issuing a full refund, we will also terminate your access to the class. Please note, we must receive your refund request on or before the fifth day from the start of the service for which you are seeking a refund.

Refund eligibility is limited to one refund per person within this five-day period. Additional requests for refunds, whether in whole or in part, will not be honored if made within the same period or for the same service.

Our 5-Star Refund Policy does not cover offers. This includes, but is not limited to, "ALL-BUNDLE" ("ALL-ACCESS") plans, " ENROLL NOW, PAY LATER" installment options, and any other discounted or promotional deals. These offers are considered final once purchased and are not eligible for refunds.

Refunds will not be provided for accounts found to be in violation of our Terms. Such determinations are made at the sole discretion of PastryClass. Should we find that you are misusing our refund policy, we reserve the right to suspend or terminate your account and restrict any future use of our services without issuing a refund.

USER SUBMISSIONS

Certain areas of this Website (e.g., PastryClassAI, blog and other functionality) may permit you to submit, post, distribute, upload or broadcast content and materials on the Website, including but not limited to text, video, audio, photographs, graphics, comments, suggestions, personal information or other material or media of any kind (collectively, "Submissions").

When you create or make available any Submissions on the Website, you represent and warrant that:

ELIGIBILITY

To be eligible for the Offers, you must be able to provide PastryClass with a valid and current payment method; and complete your purchase and enroll on PastryClass's website directly and not through a third party.

AVAILABILITY

Offers are only available for a limited time. PastryClass reserves the right to modify or terminate these Offers at any time and for any reason. These Offers may not be combined with any other sale, promotion, discount, code, coupon, and/or offer. The Offers are not transferable, exchangeable, refundable, or redeemable for cash, credit, or gift cards, nor are they valid toward previous enrollments or renewals of existing enrollments. ENROLL NOW, PAY LATER


Available for Premium and All-Bundle, Premium enrollment plans, this option allows you to enroll in these plans with 3, 4, or 6 interest-free installments, scheduled once a month. ENROLL NOW, PAY LATER cannot be combined with the GIFT A CLASS offer or other offers. A gift can only be provided for a class purchased at full price.

HOW DO I PAY IN ENROLL NOW, PAY LATER?

With ENROLL NOW, PAY LATER, you can enroll in any class or offer by dividing the payment into three, four, or six equal installments. At checkout, you’ll see an option to "ENROLL NOW, PAY LATER." When you choose this option, simply enter your card details to complete your enrollment.

There won’t be any interest, fees, or charges for using a debit or credit card with PastryClass. However, your bank might charge you interest or other fees if you use an interest-bearing credit card, for example.

ARE THERE ANY ALTERNATIVE OPTIONS FOR PAYING OFF MY BALANCE?

Yes, you can make an early payment by contacting the PastryClass Care Team via email at hello@pastryclass.com. If a payment is made earlier and the balance is cleared, we will not continue charging your card.

WHICH CARDS DOES PASTRYCLASS ACCEPT?

PastryClass accepts most cards except prepaid cards. We may also not accept a card that's due to expire in the near future.

WHEN WILL PASTRYCLASS TAKE MY PAYMENTS?

At the point of enrollment, the first of your three, four, or six payments will be automatically deducted from your card. You'll be able to see this on your card statement.

The second payment will be taken one month after the first payment, and then every subsequent month thereafter. We'll charge your card automatically when your payment is due, so you don't have to pay us back manually or worry about missing a payment.

WHAT HAPPENS IF MY CARD IS CANCELED, OR MY CARD DETAILS CHANGE?

If your card is canceled or card details change between your enrollment and your final payment, please notify us of your new details by emailing us at hello@pastryclass.com.

WHAT HAPPENS IF YOU CAN'T TAKE AN INSTALLMENT BECAUSE I DON’T HAVE ENOUGH MONEY ON MY CARD?

If we are unable to deduct the installment from your card, we will notify you and make up to two more attempts to collect the payment. If we are still unsuccessful, access to your class will be removed.

TERM AND TERMINATIONS
